Antitrust law in Latin America is evolving. Stronger cooperation among regulators and the growing influence of the OECD — to which Brazil, Chile, Colombia, Mexico and Peru are already parties — are giving rise to more stringent and sophisticated enforcement.

In the last few years, we have seen authorities in the region take a tougher stance — from imposing steep fines on companies engaging in cartel activity in Brazil, Colombia, Chile, Mexico and Peru, to pursuing criminal action to penalize bid rigging. In recent events, the Colombian authority imposed fines to a company for paying the fines of individuals in a cartel investigation. Shifts are also being seen across the region, Argentina passed a revised competition act, creating a new antitrust authority, implementing an increase in fines, and creating a new leniency program. Amendments were to made to the competition law in Peru, granting greater power to the Peruvian competition authority. In Chile, changes were made to their merger control regime. In addition, appointment of new leadership occurred in the Brazilian competition authority, CADE. These are all examples of the ever-changing landscape of antitrust law in Latin America.

Carolina Pardo is a lawyer and specialist in International Contract Law graduated from Universidad de los Andes. She obtained a LL.M. with specialization in International Private Law and Competition Law from the London School of Economics and Political Science. Over 20 years, she has advised major national and international clients on matters related to compliance with data protection, competition and consumer law rules. She has also successfully coordinated and prepared proposals for submission to national authorities on behalf of major industrial groups in Colombia. She has been recognized by Chambers Latin America as leader in the Competition ranking in Colombia, and the practice group headed by her has been ranked first for two consecutive years. She joined Baker McKenzie in 1994, and currently serves as international partner and heads the Competition, IT and Consumer Law practice group. Additionally, she is an active member of the steering committee of the Latin American Competition, Compliance and IT practice groups of Baker McKenzie.
