Resolution No. 13/2023 of 16 January 2023 of the Energy Secretariat (SE) establishes the General Conditions that hydrocarbon exploration and production companies must comply with to access Argentina’s foreign exchange market to obtain foreign currency related to their Incremental Oil and Natural Gas Production.

After much anticipation since the United States-Mexico-Canada Agreement entered into force, on 17 February 2023, the Ministry of Economy published in the Federal Official Gazette an Administrative regulation that sets forth the goods which importation is subject to regulation by the Ministry of Labor and Social Welfare, which prohibits the importation of goods produced with forced labor. The Forced Labor Regulation, which will become effective on 18 May 2023, implements the obligation included in the USMCA to prohibit the importation of goods produced in whole or in part by forced or compulsory labor, including forced or compulsory child labor

On 16 February 2023, Argentina signed the Second Additional Protocol to the Convention on Cybercrime, known as the Budapest Convention, becoming its 35th signatory state. The Second Protocol responds to the challenge of obtaining electronic evidence that may be stored in foreign jurisdictions when carrying out criminal investigations. It also aims to provide tools to enhance cooperation and disclosure of electronic evidence.

On 11 February, Ministerial Resolution No. 047-2023-MINEM/DM, which pre-publishes the “Draft Supreme Decree that establishes complementary provisions for the Detailed Environmental Plan regulated in the Regulation for Environmental Protection in Electrical Activities, approved by Supreme Decree No. 014-2019-EM” was published.

Two new regulations were published on 13 February 2023. The regulations, which directly impact the business sector, are the following: (i) Federal Decree No. 11,413/2023, which established three new reverse logistics credit certificates at the federal level: the Reverse Logistics Recycling Credit Certificate, the Certificate of Structuring and Recycling of Packaging in General and the Future Mass Credit Certificate; and (ii) Federal Decree No. 11,414/2023, which reinstituted and reformulated the pro-scavengers program, subject of former Federal Decree No. 7,405/2010, revoked in 2020.

On 1 February 2023, State Decree No. 112/20231 was published, establishing the take-back requirements system for packaging in the state of Mato Grosso. The decree is the first specific regulation on the subject in MT, regulating the state policy for solid waste (Law No. 7,862/2002) in this regard.

On 30 November 2022, Legislative Decree Number 111 was published in the Official Gazette of the Government of the State of Guanajuato.
The Decree, which came into effect 1 January 2023, added “Ecological Taxes for Environmental Remediation,” to the Finance Law for the State of Guanajuato under Chapter Eight, Title Two and established three ecological taxes
