Malaysia: Emergency Ordinance to combat fake news effective 12 March 2021
On 11 March 2021, the Malaysian Government gazetted the Emergency (Essential Powers) (No.2) Ordinance 2021 ("Ordinance") to tackle fake news, which takes effect on 12 March 2021. The Ordinance has extra-territorial application and makes it an offence to create, publish or distribute "fake news", which has been broadly defined to include not only news relating to the pandemic or the emergency but potentially any content deemed fake. The Ordinance also mandates 24-hour take down of offending publications, and grants authorities wide powers to access computerised and communications traffic data.
